1. Acceptance of Terms
By downloading, accessing, or using the Sprig Plant Care mobile application ("Sprig" or "the App") or the website sprigplantcare.online ("the Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Sprig.
We may update these Terms from time to time. Continued use of Sprig after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Service
Sprig Plant Care is a mobile application that provides:
- Plant identification using AI-powered image recognition
- Custom care schedules with watering, feeding, and repotting reminders
- Health diagnostics for identifying and resolving plant problems
- Growth tracking with photo journals and milestones
The service is provided "as-is" and "as-available." We strive to make Sprig accurate and reliable, but we cannot guarantee uninterrupted or error-free service.
3. Accounts
To use certain features of Sprig, you must create an account. When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security and confidentiality of your login credentials
- Notify us promptly of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
You must be at least 13 years old to create an account and use Sprig.
4. Subscriptions and Payments
Free Tier
Sprig offers a free tier that includes basic plant identification, care for up to 5 plants, and standard care reminders.
Premium Subscription
Sprig Premium is available at the following prices:
- Monthly: $4.99 per month
- Annual: $29.99 per year (equivalent to $2.50/month)
Billing and Renewal
- All subscriptions are billed through the Apple App Store.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Managing Your Subscription
You can manage or cancel your subscription at any time through your Apple ID settings (Settings → Your Name → Subscriptions on your iOS device).
Refunds
Refunds are handled by Apple in accordance with their refund policy. To request a refund, visit reportaproblem.apple.com or contact Apple Support.
Price Changes
We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle. We will provide advance notice of any price increases.
5. User Content
Ownership
You retain full ownership of all content you upload to Sprig, including photos, plant names, care logs, and notes ("User Content").
License Grant
By uploading User Content to Sprig, you grant us a limited, non-exclusive, worldwide license to use, store, and process your content solely for the purpose of providing and improving the Sprig service. This license terminates when you delete your content or your account.
Your Responsibilities
You are responsible for the content you upload to Sprig. You agree not to upload content that is illegal, harmful, or infringes on the rights of others.
Anonymized Data
We may use anonymized and aggregated plant data (with all personally identifiable information removed) to improve our plant identification AI and care recommendations. This anonymized data cannot be traced back to you or your account.
6. Acceptable Use
When using Sprig, you agree not to:
- Use the service for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated tools, bots, or scrapers to access the service
- Interfere with or disrupt the service or servers
- Upload malicious code, viruses, or harmful content
- Impersonate another person or entity
- Use the service in any way that could damage, disable, or impair its functionality
7. Intellectual Property
Our Property
Sprig, the Sprig Plant Care name and logo, the "Sage" brand persona, and all related content, features, and functionality are owned by Sprig Plant Care and are protected by copyright, trademark, and other intellectual property laws.
Restrictions
You may not copy, modify, distribute, sell, or lease any part of the Sprig service, nor may you reverse engineer or attempt to extract the source code of the App, unless applicable law gives you the right to do so.
8. Disclaimers
Plant Care Advice
Plant care advice, recommendations, and diagnostics provided by Sprig are for informational and educational purposes only. They are not a substitute for professional agricultural, botanical, or horticultural advice. You use Sprig's recommendations at your own discretion.
AI Accuracy
Our AI-powered plant identification and health diagnostics are designed to be helpful but may not always be 100% accurate. We recommend verifying identification of unfamiliar plants, especially before ingesting any plant material or exposing plants to children or pets.
No Warranty
Sprig is provided "as-is" and "as-available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law:
- Sprig Plant Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
- We are not liable for any damage to or loss of plants based on recommendations provided by the App.
- Our total aggregate liability for all claims arising from or related to the service shall not exceed the amount you paid for the Sprig service in the twelve (12) months preceding the claim, or $50, whichever is greater.
10. Termination
By You
You may stop using Sprig and delete your account at any time through the App settings. Upon account deletion, your personal data will be permanently removed in accordance with our Privacy Policy.
By Us
We reserve the right to suspend or terminate your account and access to Sprig if you violate these Terms, engage in abusive behavior, or if we reasonably believe your continued use poses a risk to the service or other users. We will make reasonable efforts to notify you before termination, except where immediate action is necessary.
Effect of Termination
Upon termination, your right to use Sprig ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
11. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any disputes arising from or related to these Terms or the Sprig service shall first be attempted to be resolved through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Texas.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
12. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sprig Plant Care regarding the use of the service.
- Assignment: We may assign our rights and obligations under these Terms without notice to you. You may not assign your rights or obligations without our written consent.
